AGREEMENT TO TERMS
These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“you,” “Client,” or “User”) and YigYo (“Company,” “we,” “us,” or “our”), governing your access to and use of our website, software, tools, platforms, and related services (collectively, the “Services”).
By accessing or using our Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree to these Terms, you must discontinue use of the Services immediately.
1. OUR SERVICES
YigYo provides business automation, customer communication, reputation management, and related digital services designed to help businesses manage leads, customer interactions, reviews, and operational workflows.
Our Services may include, but are not limited to:
- Automated SMS, email, and voice communications
- Missed call text-back automation
- Review request and reputation management tools
- Customer intake and lead capture forms
- Scheduling, follow-up, and workflow automation
- Analytics, dashboards, and reporting
- Integrations with third-party platforms and tools
The Services are provided for business and commercial use only.
2. ELIGIBILITY
You must be at least 18 years old and have the legal authority to enter into this agreement to use the Services. By using the Services, you represent and warrant that you meet these requirements.
3. USER RESPONSIBILITIES
You agree that you will:
- Provide accurate, current, and complete information when using the Services
- Use the Services only for lawful purposes
- Comply with all applicable local, state, federal, and international laws and regulations
- Ensure that all customer data and contact information you upload or use has been lawfully obtained
You are solely responsible for the content, messaging, and communications sent using the Services.
4. SMS AND COMMUNICATIONS COMPLIANCE
Consent Requirement
You represent and warrant that you have obtained proper, explicit consent from all recipients before sending SMS or other automated communications using our Services.
Consent must comply with:
- TCPA
- CTIA guidelines
- Carrier requirements
- All applicable messaging laws
Opt-Out
All SMS messages must include clear opt-out instructions. Recipients may opt out at any time by replying STOP.
Carrier Fees
Message and data rates may apply depending on the recipient’s mobile carrier and plan. YigYo is not responsible for carrier charges.
5. PROHIBITED USES
You may not use the Services to:
- Send spam, unsolicited, or deceptive messages
- Engage in illegal, fraudulent, or abusive activity
- Transmit malware, viruses, or harmful code
- Violate privacy, publicity, or intellectual property rights
- Harass, threaten, or mislead recipients
- Circumvent carrier rules or messaging restrictions
Violation of this section may result in immediate suspension or termination of your access.
6. THIRD-PARTY SERVICES
The Services may integrate with or link to third-party platforms (such as phone carriers, CRMs, payment processors, and review platforms). YigYo is not responsible for the availability, performance, or policies of third-party services.
Your use of third-party services is governed solely by their respective terms and policies.
7. INTELLECTUAL PROPERTY
All content, software, trademarks, logos, and materials provided by YigYo are owned by or licensed to the Company and are protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use the Services for your internal business purposes only.
8. DISCLAIMERS
The Services are provided “as is” and “as available.”
We make no guarantees regarding:
- Business results
- Increased revenue
- Lead volume
- Review outcomes
- System uptime or availability
Use of the Services is at your own risk.
9. LIMITATION OF LIABILITY
To the fullest extent permitted by law, YigYo shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to your use of the Services.
In no event shall our total liability exceed the amount paid by you to YigYo during the one (1) month period preceding the event giving rise to the claim.
10. INDEMNIFICATION
You agree to indemnify and hold harmless YigYo, its owners, employees, and affiliates from any claims, damages, liabilities, costs, or expenses arising from:
- Your use of the Services
- Your communications and messaging content
- Your violation of these Terms
- Your failure to obtain proper customer consent
11. TERMINATION
We reserve the right to suspend or terminate your access to the Services at any time, with or without notice, if we determine that you have violated these Terms or applicable laws.
12. MODIFICATIONS
We may update or modify these Terms at any time. The “Last Updated” date reflects the most recent changes. Continued use of the Services constitutes acceptance of the revised Terms.
13. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict-of-law principles.
